XIOR STUDENT HOUSING NV – GENERAL TERMS AND CONDITIONS

These general conditions apply to any remote contract concluded between Xior Student Housing NV (hereinafter referred to as “Xior”) and the student (or the person making the purchase on behalf of the student, hereinafter referred to as the “Student”). Before the remote contract is concluded, the general conditions will be made available to the Student.

These general terms and conditions must be accepted prior to the purchase and are therefore an essential part of the agreement between Xior and the Student.

Article 2 – The remote agreement with Xior

2.1. Xior offers a number of items in its webshop, whereby a description of the offered items with the corresponding price is indicated. The description is sufficiently detailed to enable a proper assessment of the offer by the Student.

2.2. To place an order, the item will need to be added to the shopping cart. The Student can then choose the number of items. Subsequently, the Student will have to enter his personal data, being the name, first name, email and phone number and will have to choose the payment method. Afterwards, the Student must enter the payment details. After payment by the Student, the contract is binding. Xior always sends a confirmation of the order to the e-mail of the Student as specified in the order.

Article 3 – The delivery of the items

The ordered items will be delivered within a maximum of 15 working days at the rental office in the city where the Student rents a student room from Xior, or at the Student’s student room. The Student will receive an e-mail from Xior as soon as the order has been delivered to the rental office, informing him that he can pick up the order or that the order has been delivered to the Student’s room.

Article 4 – The right of cancellation

4.1. The Student has the right to cancel the agreement free of charge and within a period of 14 days. The cancellation period expires 14 days after the day on which the Student has collected his order in the rental office of Xior or 14 days after the day on which the order has been delivered to his student room.

4.2. To exercise the right of cancellation, the Student must inform Xior by e-mail (returns@xior.be) of his/her decision to cancel the agreement. The email must contain the following information:

“I hereby inform you that I am cancelling our agreement regarding the sale of the following items:
— Name of the package you wish to return (packages can only be returned in their entirety):
— Name;
— Address;
— Phone number;
— Residence and city;
— Ordered on / received on (*);
— Reason for cancellation;”

In order to comply with the cancellation period, it is sufficient that the Student has sent the mail regarding the exercise of the cancellation right before the cancellation period as stated in Article 4.1 has expired.

4.3. During the cancellation period, the Student shall handle the ordered items and their packaging with care. He shall only unpack or use the item to the extent necessary to determine the nature, characteristics and functioning of the item. The Student shall only be liable for the reduction in value of the items resulting from handling the items beyond what was necessary to determine the nature, characteristics and functioning of the items.

4.4. As soon as possible, but within 14 working days from the day following the notification referred to in article 4.2, the Student will hand over the items to (an authorized representative of) Xior. Packages must always be handed over in their entirety.

Article 5 – Obligations of Xior in case of cancellation

5.1. If Xior receives a notification of cancellation, Xior shall send a confirmation of receipt to the Student immediately upon receipt of such notification.

5.2. The items will be refunded by Xior within 14 business days of the Student’s cancellation provided that the Student has cancelled the agreement in accordance with Articles 4.1 and 4.2 and has handed the items over to Xior harmlessly (i.e. not showing any damage beyond what is necessary to determine their nature, characteristics and functioning) within the cancellation period.

5.3. Any refund will be made automatically to the account the Student used for the payment. The refund is free of charge to the Student.

Article 6 – Complaint procedure and conformity of articles

Complaints or questions about the execution of the agreement or about the items ordered must be clearly described by the Student and submitted to Xior via the e-mail address webshop@xior.be.

Xior provides the Student with the legal guarantee for latent defects if the latent defect existed at the time of delivery and if the defect renders the goods unsuitable for the use for which they are intended or substantially impairs their use. Any latent defect must be brought to the attention of Xior as soon as possible via the aforementioned e-mail address from the moment that the Student has discovered the defect, or, as the case may be, should have discovered it.

Article 7 – The processing of personal data

The customer data that the Student must provide when placing an order may include personal data. Xior processes the personal data of the Student such as name, first name, e-mail address, phone number and bank account number in order to execute the remote contract. Xior processes these data for the execution of an agreement to which the Student is a party and on the basis of the Student’s consent given at the time of the order. Xior processes the personal data as a data controller in accordance with the applicable privacy legislation (General Data Protection Regulation (Regulation (EU) 2016/679) and the national implementing legislation).

Article 8 – Litigation

Agreements between Xior and the Student to which these general terms and conditions relate are governed exclusively by Belgian law.retusn
